Lawyers and Legal Profession

Lawyers and Legal Profession:

Life is very unpredictable. Nobody knows what’s coming next. If any of you is into legal things and hiring or in the middle of court hearings, and then suddenly your lawyer dies, announces retirement, or stops practicing law, what would you do?

It means you have to start planning with a new lawyer about your case. What exactly does this mean? Generally, it means you have to find new lawyers who will be suitable for your case and that new lawyer will create a whole new case in his or her way. So, again you have to spend thousands of dollars as well as give time. This is true and a bitter reality because no new lawyer will take that planning or research which has been done by your previous lawyer. Why do these new lawyers do that? Because they don’t want to take a risk as according to their thinking the previous lawyer must have made some mistakes. Their process may not be understandable to the new lawyer. It means you have to start all over again with the new lawyer. A whole new process, whole new documents, dates, planning, fees, etc. This can be very ugly and frustrating. The only thing that can save you from all these things is to communicate. Communication is the only way to get precautions before you start with any lawyer. If you have not planned yet then ask the following question with your lawyer:

  1. What will happen if you (lawyer) dies in between the court hearing or announce retirement?
  2. Will I have to start from scratch?
  3. Is your succession plan ready?

Like there is a saying, “cobbler’s kids have no shoes”. The same goes with the lawyers as most of the lawyers don’t have their estate plans. Communicate as much as you can to make yourself clear and get the answers to your doubts. It's not easy to pay thousands of dollars again, a waste of time and energy. Ask your hired lawyer to keep you updated with the case, make it up to date. Ask them whether you have to initiate the questions or they will keep communicating with you about the case?

The legal profession has been there for many good years and it’s common thinking that lawyers earn a good amount of money, are stable, and have a lucrative profession. Maybe there were times when all these assumptions were true but now in today’s era it's not.

Who determines the salaries of these lawyers?

There are many factors involved in it that determine the number of professional fees that these lawyers can demand from their clients.

  1. The type of practice that lawyers do influences their salaries as well. For example, if any lawyer is practicing criminal law then they have to deal for or against the criminal. Which party gives what amount of money it depends on them.
  2. In which area, city, or country they are practicing their law also affects their salary range. Advocates who have offices in big cities and posh areas then their fees will also be according to that. If not ten their fees will be below.
  3. The public prosecutor and private prosecutor have a difference in their salaries. As private lawyers practice with profits in their minds whereas public lawyers work on the demands of the government.
  4. Which lawyer is associated with which firms also affects the salaries. If any lawyer who just graduated from college and joined any law firm which has a name and works in a posh area, then it might be possible that his or her starting salary will be good. But, if not affiliated with the big-name then their salaries will be low as well.
  5. Last but not least is the experience. If you have years of experience, then your salary will be higher than the one who just graduated or joined any firm, by virtue of that lawyer practice in this profession.

Despite these points and factors this profession is overrated and is glamorized by many people. But, in reality, no one sees that these lawyers have put their sweat and blood into their profession. Debts in law college, long working hours, effort and time, maintaining credibility with ethical values. No one notices all these things but their salaries range.
